A bench of three judges will tomorrow decide whether they will visit the Kenyatta International Conference Centre as they determine the fate of new currency notes.

The judges will, however, rule on the matter after hearing final submissions from the parties who include the petitioners among them Okiya Omtatah, Simon Mbugua and Central Bank of Kenya.

“Court shall decide whether or not to visit the site in the course of those submissions. If the site visit will be of importance it will visit KICC at 2pm,”court directed.

The judges who include Justices George Kimondo, Anthony Murima and Asenath Nyaboke said that the matter is of great importance and of public interest therefore allowed activist Okiya Omtatah to file his submissions by end of business today.

Omtath says that the site visit is of great importance adding that it will help clarify issues in the case. “The site will enable this court to determine for itself whether or not the Kenyatta statue is part of the KICC building,” Omtatah said.

According to Omtatah the visit will also enable the court see the plaque on the high pedestal carrying Kenyatta statue.

The Activist is accusing the CBK of violating the Constitution by having a statue of Kenya’s founding President Jomo Kenyatta at the back of all the new notes.

Omtatah argues that the move by CBK violates Article 231(4) of the Constitution. He accuses the CBK of not conducting public participation in the design stage to determine its imagery.

“The Constitution decrees that Kenyan currency bank notes shall not bear the portrait of any individual,” said Omtatah.
