Fourteen Moi university students have moved to court seeking to block the university from conducting the 38th graduation ceremony next week.
In an urgent application filed before the High court the students want the court to issue conservatory orders stoping moi university from conducting the 38th graduation scheduled for August 22, 2019.
The petitioners namely Violet Atieno, Obegi Ochweri, Ndirangu Tabitha, Verah Manyonyi, Maureen Kwamboka, Yvonne Buluma, Omondi Akinyi, John Muthoni, Sarah Wanjiku, Jakoyo Akinyi, Ruth Mwangi, Karanja Waithera, Patience Kamutu.Urgue that they risk missing their graduation on August 22, 2019 and suffering immensly if the application is not heard and determined urgently.
They claim on August 11, Moi university published the list of graduands to the 38 graduation ceremony scheduled for August 22 2019 with their exclusion who have met all the requirement for the graduation.
Further, they argued their exclusion from the graduation list is illegal,unlawfull and breach of their constitutional right.
“Being concerned for students who have worked hard for their degree course, having paid fees and when required and done their due deligence and followup for their graduation but who now risk not graduating on August 22 justifies the grants of conservatory orders and temporary injuction to protect and enforce the rights and fundamental freedoms of the bill of rights”, reads the court papers.
However Justice John Mativo certified the application urgent and directed the matter to be heard tomorrow morning and the university representative should be in court.
