Nairobi children court has ordered former National Seven Rugby Coach Ayimba Benjamin Otieno to cater for his two children school fees and school related expenses pending hearing of the application filed by the mothers child.

This is after a woman filed an application before the children court seeking orders for Ayimba to be ordered to provide 50,000 as monthly rent and and Ksh. 100,000 as 2 months deposit  respectively to commence in December pending hearing and determination of the child case.

The mother of two urged the court to order Ayimba Benjamin Otieno to pay a reasonable upkeep for the minors Ksh. 50,000 per month immediately.

The mother of two wants the father of his children to deposit Ksh. 100,000 and Ksh. 50,000 (names withheld) for each minor respectively starting December 1 this year to enable her source for a new school for the minors before January 1,2020.

The mother of the two children also urged the court to compel their father to spend 50% of the holidays and weekend with the minors as part of his parental responsibilities.

According to court documents filed before Milimani children court, Ayimba and the mother of two are married and cohabited for 10 years  and are blessed with the minors who are the subject in the case.

It is in the minor’s best interest that the mother moved to court being apprehensive that their interest welfare is at risk.

“My husband Ayimba Benjamin Otieno without reason stopped providing shelter for the minors subjecting them to auctioneers in December 2018 with 6 months arrears amounting to Kshs. 150,000 plus auctioneers fees of Kshs. 30,000 thus rendering them homeless.” Said the mother of two.

She told the court that the husband has unfairly and unreasonably neglected and abandoned the two minors and without a reason stopped providing health cover for them subjecting the two to poor if no healthcare at all.

A case in point is June this year when one of the minors got pneumonia attack and took the intervention of family and friends to procure treatment after all her messages and calls to the father went unanswered.

She accused the father of stopping to pay school fees for the minors and as a result have missed school for 4 respective terms since 2018 to date.

She told the court that their father who is the provider, without a reason, stopped providing upkeep for the minors subjecting them to untold suffering and on several occasions going without food and felt and left with tattered clothing as their only option.

“As a result of their father’s actions , the minors have been subjected to untold psychological torture and an undignified way of life. ” Added the mother.

The mother of two said his husband Ayimba is a man of means with five other biological children and one stepson who are well taken care of as distributed and indicated.

She said the the husband has without embarrassment continued to mock her and the minors by flaunting photos on social media of his other children in expensive schools.

She said the husband has threatened her against bringing him before the children court regarding the two children.

“Defendant (Ayimba Benjamin Otieno)discriminatory behavior if goes unchecked by this court poses a significant danger to the wellbeing of the minors.” Mother told the court.

She said the husband’s actions are tantamount to child neglect which is a criminal offence under penal code and against the spirit of the constitution of Kenya which protects the minors.

She said that in April, having accumulated more arrears since January of 2018, she reached out to the landlord and explained the disappearance of their father and requested to move out and the landlord sympathized with her and the minors and opted to let them go with arrears that have since not yet been paid.

In May this year, she relocated to a smaller house within same estate.

She said that she met with Ayimba in 2009 through her co-wife’s  cousin while living in south C and subsequently consummated their relationship and later joined him in South C where he lived with her second co-wife. In May 2010 her co-wife was blessed with a child.

She avers that while at South C, she was the one left with responsibility of raising and taking care of the children and in 2012 Ayimba proceeded to marry a fourth wife and his decision to marry fourth wife tension started building up in South C and was therefore relocated to Donholm.

She was blessed with a child in the year 2013 and another one in year 2015.
In the year 2016 they relocated from Donholm estate in Embakasi to Sunset Boulevard Athi river at a cost of Ksh. 90,000 being rent of Kshs. 30,000 and deposit of Ksh. 60,000 respectively.

The mother of two added that that, Ayimba continued providing for them food, shelter , and met all the basic needs pertaining to her and the minors.
