Seven people have been charged with forging an allotment letter with plans to illegally takeover a parcel of land in Nairobi.

Edward Kosgei, Stephen Gitira, Samuel Njue, appeared before Milimani chief magistrate Susan Shitubi to face charges of conspiracy to defraud. Their c-o-accused- Eliud Chepkwony, Bonface Lurare, Jane Muse, Samuel Njue and Simon Maina were not in court.

The charge sheet stated that the seven made forgeries to a parcel of land measuring 3.0 hectares, which had not been surveyed.

Kosgei, Gitira and Njue are accused of jointly forging an allotment letter dated January 11, 2000 for the parcel of land. The court heard that they committed the offence with others not before court by claiming that the land had been allocated to Chepkwony, Lurare, Muse, Njue, and Maina.

The court heard that they purported that the allotment was a genuine and valid letter issued by the Commissioner of Lands.

It is further alleged that with intent to defraud Gulflink Enterprises Limited of their land deed plan, Njue forged an allotment letter dated May 29, 2006 and another one dated March 19, 2013, with intent to defraud.

He is further accused of unlawfully obtained registration of the property an offence he allegedly committed on August 14, 2020 at Ardhi house in Nairobi County, with intent to defraud

Gitira is accused of forging a deed plan on August 13, 2020 at Survey of Kenya, purporting to be a genuine and valid deed plan issued by the Director of Survey.

While Kosgei, Gitira and Njue denied the charges, their co-accused were directed to present themselves before the DCI on April 6 for processing and to appear before court the following to answer to the charges.

The three were ordered to deposit a bond of 2 million, each to secure their release.

The matter will be mentioned on April 19, 2022 for pre-trial.
