Two men have been charged with conspiracy to defraud a land buyer of Sh20.1 million for a non-existent parcel of land.
Luke Kipchumba Metto and Eric Agbeko appeared before Milimani Chief Magistrate Wendy Kagendo and denied the fraud charges.
The two are alleged to have conspired to defraud Agnes Mwendwa Marete and Kennedy Obuta of Sh20.1 million by falsely pretending that Metto was the registered owner of a land parcel measuring 0.236 hectares.
The charge sheet stated that they committed the offence on diverse dates between March 30, 2018 and May 23, 2020, jointly with others not before court, with intent to defraud.
The court heard that Mwendwa and Obuta paid Metto the amount towards the purchase of the said land.
Further, Metto was accused of forging a sale agreement, an offence he allegedly committed jointly with others not before court. It is alleged that he forged a sale agreement for land between him and Milka Wambui Wachira.
Metto also allegedly presented the false sale agreement on March 30, 2018 to Ogwoka Ndege & Company Advocates office Nairobi, within Nairobi County, purporting it to be genuine.
The court ordered Metto to deposit a bond of Sh1 million or an alternative cash bail of Sh500,000, while Agbeko was released on a bond of Sh500,000 pending hearing and determination of their fraud case.
