TRADER CHARGED OVER FAKE TITLE IN SH600 MILLION KAREN LAND.

A businessman has been charged with fraudulently obtaining registration of a land worth Sh600 million.

Shailesh Babubhai Mistry appeared before Senior Principal Magistrate Robinson Ondieki and denied several charges.

The charges against Babubhai were that he willfully procured for himself the registration of a land in the name of Hells Ltd situated at Bogani area, Karen Nairobi County, with intent to defraud Smeth Wall Ltd of its land.

The court heard that he committed the offence on January 1, 1998 at Nairobi land registry being the director of HELLS limited.

The land measures approximately 4.047 hectares and valued Sh600 million and that he falsely pretended that he was the genuine owner of the said parcel of land.

Babubhai and Hells Ltd are accused of making a certificate of title of land in the name of Hells Ltd purporting it to be genuine and valid certificate of title signed and issued by Mohamed Billow Ibrahim, a land registrar Nairobi registry, a fact he was false.

The prosecution further told the court that Babubhai and Hells Ltd jointly made a certificate of title in the name of Hells Ltd purporting it to be genuine, an offence they allegedly committed on or before January 1, 1998 at unknown place, being the director of the said company.

The charges were that they committed the offence with others not before court without lawful authority and with intent to defraud Smeth Valley Ltd of the said land.

Babubhai was also accused of uttering a false certificate of title for the said land to Sergeant Japheth Ng’etich, a police officer, purporting it to be a valid and genuine certificate of title signed and issued by land registrar- Mohamed Billow Ibrahim.

It is alleged that he committed the offence on July 14, this year at Directorate of Criminal investigation headquarters on Kiambu Road, Nairobi, being a director of Hells Ltd.

He was released on a cash bail of Sh500,000 and the case will be mentioned on October 25, for directions.
