A mother of one has taken business mogul Jimnah Mbaru to court seeking over Sh4.4 million per year for child support.

The 24-year-old mother of one who claims to have sired a child with with the city tycoon in 2018, is seeking millions claiming that the wealthy Mbaru has neglected his parental responsibility.

The young mother alleges that Mbaru donated his parental responsibility to one Erick Murimi Kaburu through a power of attorney, thereby, treating the minor as a ‘property of chattel goods.’

The woman through lawyer Lempaa Soyinka alleged that the business mogul gave the power of attorney to Erick Murimi Kaburu whom he gave power of attorney to be the child’s ‘putative father’ and pay Sh 50,000 monthly upkeep to her, terms of which are not known in any law.

“The said Memorandum of Understanding dated 10th September 2020, the “putative father” was required to pay Sh. 50,000 per month, which amount has not been remitted for the maintenance of the minor,” she claims in court documents.

The woman further wants Mbaru to pay Sh 600,000 annually for the minor who is enrolled at Kitengela International School located in Kajiado county 

According to documents filed in court, the woman has been solely taking care of the minor and has never received any financial support from the father despite numerous attempts to have him do so.

She wants the court to issue a maintenance order requiring Mbaru to pay for the minor’s school fees and education related expenses, medical cover, shelter, and food.

In the Monthly expenses she seeking sh 50,000 for food, sh 50,000 medical expenses, sh 50,000 for clothes, sh 100,000 for shopping, Miscellaneous expenses sh 20,000 and house help sh 50,000.

She accuses Mbaru of neglecting the minor, by giving a stranger power of attorney to take care of mental, physical, and emotional well-being while he is the biological father.

She defines Mbaru as a senior citizen, a prominent businessman who owns businesses worth billions of shillings including banking and control of Nairobi Security Exchange and therefore capable of supporting the child without any difficulties.

She says Mbaru has refused to have his name indicated in the birth certificate of the minor therefore denying the child the benefit of a biological father.

She wants an order compelling Mbaru’s name to be included in the birth certificate of the minor as his biological father.

The court heard that on or about 28th July 2022, the mother wrote a demand letter to Mbaru through her advocate regarding child support but the businessman ignored it.

According to the mother, Mbaru is a prominent businessman who owns businesses worth billions of shillings including banking and control of the Nairobi Security Exchange and therefore culpable of supporting the child without any difficulty.
