SENIOR LAND OFFICIAL DENIES FRAUD CHARGES.

Kajiado Land Registrar and an accomplice have been charged with conspiracy to defraud land.

Jonathan Kimutai Koskei and Victor Baraza Odhiambo appeared before Milimani Chief Magistrate Lukas Onyina and denied the charges.

The charge sheet stated that with intent to defraud, the duo made a land sale agreement for sale of land between Koskei and Odhiambo dated 1st march 2013 purporting it to be a genuine and drawn by M. Korongo and Company Advocate s.

It is alleged that they committed the offence on or before March 1, 2013, at an unknown place, with intent to defraud Hadiko Co Ltd of land parcel number Kajiado/Kitengela/30828.

The parcel has a house all valued at Sh14 million.

Odhiambo is accused that on unknown date at Kajiado County land registry within Kajiado County, willfully procured for himself registration of land title deed for land parcel number Kajiado/Kitengela/30828 measuring 0.09 Hectares, valued at Sh14 million by falsely pretending that the said property was genuinely transferred to him.

The court also heard that on unknown dates between September 2013 and February 2014, at Kajiado Land Registry within Kajiado county, knowing that the Green card and documents contained in parcel file including transfer forms for land parcel number Kajiado/Kitengela/30828 might be required in evidence in a judicial proceeding, Koskei willfully destroyed them with intent to prevent their being used in evidence.

Koskei is further accused that on diverse dates between 3rd May, 2012 and 5th August, 2013 at Kajiado land registry within Kajiado County, being a land registrar Kajiado used his office to improperly confer a benefit by transferring land parcel number Kajiado/Kitengela/30828 measuring 0.09 Hectares, valued at Sh 14 million to his name and used the same as a collateral at I&M Bank Kenyatta Avenue branch to obtain a loan of Sh 13 million

The accused was released on a bond of Sh1 million .

The case will be mentioned on March 27, this year.
