Director of Public Prosecution Noordin Haji has opposed the release of two Congolese nationals charged with obtaining over Sh27 million in gold fraud.

Haji through prosecutor Anderson Gikunda opposed the release of Mathieu Bayindu Patsamu and Marcelin Wa Nyanguangi Bruce arguing that the two foreigners are a flight risk.

Bayindu Patsamu and Wa Nyanguangi Bruce denied the charge before Milimani Chief Magistrate Douglas Onyina.

They asked the court to be released on bail, pending the hearing of the case.

They allegedly obtained the money from a South Korean businessman by claiming they were in a position to sell gold.

The charge states that they committed the offence on diverse- dates between 8th day of January 2023 and 5th day of April 2023 in Nairobi.

It is alleged that they obtained USD 214,500 equivalent to Sh27,585,000 from Tophead Vision Company in South Korea with intent to defraud.

They defrauded the millions by falsely pretending that you had sold and shipped to the said company in South Korea,175 kilograms of Gold from the Democratic Republic of Congo (DRC) through Nairobi and that the same was being held at the Jomo Kenyatta International Airport on transit to Seoul, Korea vide Turkish Airlines Airway Bill No. NBO72215518, a fact you knew to be false.

Prosecution further told the that on the diverse dates between the 8th day of January 2023 and the 5th day of April 2023 in the Republic of Kenya within Nairobi City County, jointly with others not before court, conspired to commit a felony namely obtaining money by false Pretence USD 214,500 equivalent to Sh27.5 million.

The court will rule on the bail application on Monday.
