An Azimio la Umoja supporter will remain in police custody for one week as police investigate him over claims of incitement.

Shadrack Omondi alias Omosh Jakababa arrested after he had allegedly published a tik tok video stating “Baba enda Russia utuletee bunduki”.

In a miscellaneous application filed before Principal Magistrate Martha Nanzushi, an investigating officer says the video indicated that once the weapons were acquired, they would be able to face off with the law enforcement appropriately.

The investigating officer Nickson Kinyua informed the court that the utterances were an incitement to take up arms to advance protected area to wit ‘statehouse’ without the permission of the authority.

Kinyua made an application for the court to grant detain the suspect for 14 days, to enable him complete investigations.

Omosh through his lawyer Danstan Omari opposed the application stating that the said tik tok account and telephone number hasn’t been linked to him.

He further said the statement “baba enda Russia utuletee bunduki” does not display an offense.

Omari further told the court that the word “baba” is normally a kiswahili term for father and there’s a variety of meaning to the term “bunduki” it could have been “bunduki” for hunting or a toy.

He also told the court that police came up with their own interpretation of the statement and concluded that Omosh had intended to use the guns to overthrow the government.

Omari stated that there is no offense of treason from the statement made by the ODM supporter does not disclose the offense of treason as implied by the police.
