A Magistrate has issued an arrest order against the fugitive Kelvin Kinyanjui Kagethe who escaped from Muthaiga police station on Thursday evening.

Milimani Chief Magistrate Lukas Onyina issued the warrant of arrest against fugitive Kagethe alias Kelvin A Kagethe after Director of Public Prosecution applied for the same.

Kang’ethe was supposed to appear before Chief Magistrate Onyina on Friday, February 9,2024 for hearing of his bail application but went missing following his mysterious disappear from custody.

He had applied to be released on bail pending extradition proceedings before court.

Earlier court allowed Directorate of Criminal Investigations (DCI) Homicide department to detain him for 30 days.

The led prosecutor Vincent Monda, told the court the fugitive who was in custody at Muthaiga Police station had disappeared from the lawful custody of the police and he is yet to be arrested.

Monda told the court that the OCS Muthaiga Police Station had confirmed to the DPP that Kang’ethe had disappeared at 1600 hours after which they never came in contact with him again.

He said that Patrick Wachira on behalf of the Dpp had filed an affidavit on his arrest and that Kang’ethe should be directed Directorate of Criminal Investigation (DCI) homicide division in case an arrest is made.

He further submitted that the proceedings cannot take off in the absence of Kang’ethe as a fugitive criminal and requested for a mention date in a weeks time.

The defense through lawyer Mohamed Ahmed contested the submission by the dpp that Kang’ethe escaped the police custody and demanded the DPP to present a physical evidence to support the same allegations.

He said that the last they were in contact with Kang’ethe was at the Muthaiga police station in presence of the police .He added that his lawyers together with his family fear for his life.

Police officers on duty and a lawyer are in police custody to help police with investigation of fugitive escape.
