A Nairobi court has issued a warrant for the arrest of a Kenyan wanted in Rwanda to serve five year jail sentence over fraud.
This is after Director of Public Prosecution Noordin Haji notified the court that Kenya received the request from Rwanda for the extradition and surrender of Nathan Loyd Ndungu.
According to warrant seen by NairobiTimez, Haji has commanded Director of Criminal Investigations George Kinoti to arrest Ndungu (fugitive criminal) and bring him for the prosecution or before any Magistrate court to be dealt with according to the law.
The DPP also notified Milimani Chief Magistrate court that the request to extradite Ndung’u has already been officially received.
The Kenyan is wanted in Rwanda to face justice over fraud. He was convicted and sentenced to five years in prison in absentia and has been on the run until his arrest in January after jetting back to the country from abroad.
“A request has been duly made to Kenya by Prosecutor General of Republic of Rwanda for extradition and surrender of Nathan Loyd Ndungu(fugitive criminal) who is alleged to be residing in Kenya and who is convicted and sentenced to an imprisonment term of five years by Kacyiru Primary Court for selling and pledging as a security a property belonging to another person”, state the order.
According to the order, the said crime is provided for and punished in Article 323 of the organic law N 01/2012/OL of 02/05/12 under Penal Code of Rwanda.
Last week, Ndungu approached the high court seeking to prohibit the government from extraditing him to Rwanda or any other place outside Kenya.
Through lawyer Nicolas Nyamai, the businessman wants the court to quash Interpol Red Notice issued against him by the government of Rwanda.
He further sought IG, DPP and Magistrate Court in Milimani stopped from acting, executing or enforcing the notice or commencing criminal proceedings against him.
Through lawyer Nyamai, he also sought to be compensated for damages suffered as a result of the said Interpol Red Notice.
According to the documents filed in court, on the evening January 31 this year he jetted into Jomo Kenyatta International Airport in Kenya from overseas medical treatment trip and after he presented his passport to immigration desk and the same was detained ostensibly on the basis there was an Interpol Red Notice.
He was arrested and detained on various police stations and he was arraigned in court on February 2, when he was informed that he was required to serve a criminal sentence in Rwanda
