Former Devolution and planning Cabinet Secretary Ministry Anne Waiguru who have sued Machakos Senator Johnson Muthama and Senator for Kakamega County Boni Khalwale over defamation

Former Devolution and planning Cabinet Secretary Ministry Anne Waiguru have sued two Coalition for Reform and Democracy (CORD).
She has sued Machakos Senator Johnson Muthama and Senator for Kakamega County Boni Khalwale over defamation.
Waiguru Moved to court on Wednesday through her lawyer Mohamed Nyaoga under certificate of urgency claiming the two Senators defamed her during a Coalition rally on September 23, 2015.
In her court documents, she claims the defamatory words were uttered at a political rally held at Uhuru Park in Nairobi uttered the words in Swahili that when translated to English reads as follows
“Mr, President, you are the only person who knows the amount of money that was pocketed by Anne waiguru, I am asking is Waiguru sweater that honey?
Do I reveal or do I not?
We will not sit still and watch as Waiguru takes nine hundred million shillings and the president stands and defends her saying ‘Waiguru is not a thief….and then asks Ngilu to step aside, but the love of his heart is told to take money!

The documents seen by Nairobi Times, Waiguru claims that he received calls on that day from friends and relatives requesting her to watch Citizen TV and watch how Muthama and Khalwale were making terrible comments about her.
“I went online and watched what was termed as CORD solidarity rally, I was shocked to hear the two accuse me while addressing a crowd calling me a thief, corrupt and embezzler of public funds,” said Muigai in court documents
He added that they spoke about Waiguru in derogatory terms alleging that she was immoral, promiscuous and engaged in immoral conduct.
Waiguru claims that since that day up to now her friends and relatives keeps on calling her asking whether those words were based on truth.
She continued that the words were widely published by different media stations and social sites.
The former CS added that by the time the words were uttered there indeed was an issue of misappropriation of funds in her ministry.
She said that she had reported the issue to the police for investigation.
Waiguru says it was wrong for the two Senators to conclude that she was the embezzler of the missing funds without waiting for the conclusive report from the police who were investigating the issue.
According to her, during her term as Devolution CS She upheld the Integrity and conducted many duties with honesty and dedication.
She claims that the two uttered the defamatory words against her. Waiguru is also seeking compensation for general damages and punitive damages.
