TUNOI TRIBUNAL FACES HURDLE OVER ITS LEADERSHIP.

Political activist Okiya Omtatah has filed an application seeking the suspension of a tribunal appointed by President Uhuru Kenyatta to investigate the conduct of Supreme Court judge Justice Philip Tunoi.

Mr Omtatah, says that the President violated the law by appointing Sharad Rao as the chairman of the tribunal.

He says that the law requires that the person to chair such a tribunal must have been a judge of a higher court.

The activist argues that Rao has never been a judge and his age cut does not permit him to chair a tribunal investigating a judge of the high court or Supreme Court.

”Rao is  not qualified  to be appointed a judge of the high court or court appeal due  to his age” he  says.

Mr Omtatah therefore wants the court to issue an order suspending the hearing at the tribunal or stay of any proceedings to be presided over by Rao.

He will be further seeking an order to quash gazette notice No 1084 dated 23  February 2016 containing  members of the tribunal.
The application will be placed before a duty judge for further directions.

Justice Tunoi is alleged to have received Sh200 million from Nairobi Governor Evans Kidero to influence a judgement in favour of the latter.
