Former NTV Freelance Journalist Dola Moses who allegedly killed broadcaster Wambui Kabiru in the year 2011 will know his fate on March 10.

State counsel Catheline Mwaniki said sixteen witnesses have already testified in the case and they are convinced that the evidence tabled can warrant conviction against the accused.

“The prosecution evidence is clear and the accused person lied about the whereabouts of the deceased immediately after the incident,” said Ms. Mwaniki.

Justice Roslyn Korir heard that it is clear the bedroom of the accused was locked and he denied the deceased medical attention.

Mwaniki added that the medical examination confirmed that the deceased was hit with a blunt object.
She submitted that the prosecution evidence is consistent and that it was clear that after the incident the accused called the parents of the deceased informing them that he had killed their daughter.

The prosecutor continued that the two journalists had a child and the accused disappeared leaving the child under the care of their house help.

She added the accused acted in a guilty manner and also presented himself to the police. She said that an arguable case has been established and the accused stood to be convicted.” The evidence presented before court is truthful and we have closed our part,” said Mwaniki.

One of the witness had earlier told the court that the police did not forward to the Government Chemist some of the items recovered from the house of former NTV presenter who was murdered by her husband.

Buruburu Officer Commanding Station, Mr Johnston Matoke who testified in the case said that only few of the items were collected from the scene of crime.

In his testimony, Matoke said that after arriving at the scene of crime, he discovered that the bedroom door had been broken and the deceased was lying on the bed. “I met a lot of people assembling there and I was told that the accused had committed the heinous crime,” he said.

Matoke added that it took him ten minutes to reach to the scene of crime, claiming that there were two pillow cases and two pillows covered with blood. According to him, he took only one pillow that the deceased had been lying on.

He was asked to explain why he never carried the two pillow cases to the chemistry but he said that question could have been posted to a crime of scene photographers.

Defense lawyers while cross examining him also demanded to know why there was no photograph that indicated a broken door. “I took one pillow case, a bed sheet and a lesson and all were covered with blood, I took them to the Investigation officers for further examination,” said Matoke.

Dola is out on a cash bail of Sh 500,000. It is said that he strangled Kabiru by either using his bare hands or a cloth.
Her neck was swollen when police broke into the bedroom where the body was found. The prosecution also argued that their son was in the house with the house girl as his mother was being killed.
