IEBC Chairman Issack Hassan has filed a suit seeking to cite the Auditor General Edward Ouko for contempt of court.

The auditor, he says has not complied with an order issued on May 29 2015 requiring him to delete information contained in special investigation report on the procurement of Electronic Voting Devices for the 2013 general elections.

Through his lawyer Paul Nyamodi, Hassan asked Justice Isaac Lenaola to compel Mr Ouko to expunge that information appearing on page 28 of his report.

The said information adversely mentions Hassan over the procurement of the voting materials used in the general election conducted on 6 June 2013.

Mr Nyamodi said that the special report was prepared by Ouko for purposes of tabling before the National Assembly and adopted by Public Accounts Committee on March 23 2016.

It was the subject of a heated argument between Hassan and the PAC members.

He said that the auditor general failed to inform PAC on existence of the order and decree that required him to delete information regarding him.

If the application is successful, Ouko could even be jailed.

Proceedings resume July 19. By then Ouko should have responded to the suit.
