Patrick Kabudu, a TNA official has asked the acting Chief Justice to compose a bench of seven judges to hear a constitutional appeal over the prosecution of criminal matters by County government officers.
He says there is an abuse of the powers donated to the director of public prosecution by the constitution.
Mr Kabundu wants the bench to determine whether the 47 counties and county courts which members of the public feel have been used to milk money from them.
He says that members of the public are being prosecuted without due process of law, saying its the DPP who has the mandate to conduct prosecution in court established under the judiciary.
The officers from inspectorate department of the County Governments lack legal knowledge to prosecute which also does not fall under them.
The laws applied by this courts have not been passed by Parliament and the Senate and will be asking the bench to make the finding that Counties have abused the constitution by allowing Kangaroo courts to carry out prosecution.
He says Kenyans will be saved from harassment and extortion.
