Residents of Nairobi County want Water Cabinet Secretary Eugene Wamalwa stopped from eyeing the Nairobi gubernatorial seat.
Mr Evans Okwara Ndubi and Julius Kulundu Asiba have filed a petition at the High court claiming that Wamalwa should first resign as Cabinet Secretary before he engages in campaigns.
“We are seeking orders restraining the respondent from campaigning for the Nairobi governorship post until he resigns,” they said in an affidavit.
He claims that the CS is engaging in politics contrary to the oath and statutory declaration of a public officer.
They hold that he has to relinquish his current position as a Minister.
Wamalwa they claim is misusing state resources to advance his personal interests.
They claim that concerned Kenyans are alarmed by Wamalwa’s acts and request the court to declare the said act illegal and unprocedural.
“The CS has publically abused and continues to abuse the constitution of Kenya by engaging himself in political affairs contrary to the law in which he took to defend the constitution when he assumed office as the CS in the ministry of water and irrigation,” said Okwara in court documents.
They have requested the court to issue orders restraining Wamalwa from further campaigns.
They also him declared unfit to hold public office.
