Outspoken Jubilee Critic and ex-Lugari MP Cyrus Jirongo will not answer to a Sh50 million fraud case against him, judge Odunga gives him amnesty.

High Court Judge George Odunga quashed a decision by the Director of Public Prosecution to charge Jirongo over the fraud.

The court case is over two decades old.

Jirongo told the court that it would be unjust to prosecute the former law maker now for a crime that happened over 20 years ago.

“Use of the criminal process to subdue the respondent is misuse of court process,” Judge Odunga ruled.

The prosecution had alleged that the former Youth for KANU 92 (YK’92) chairman gave false information, forged land documents and used security apparatus by false pretenses.

The prosecution claimed that on September 25, 1992 in Nairobi, Jirongo induced Postbank Credit Limited to accept a bank charge in respect of LR NO 209/11151-IR 47029 registered in the name of Soy Developers Limited to secure an overdraft facility of Sh50 million to Cyber Project International as valuable security.

He was further accused of giving false information regarding Jonathan Moi in the fraud case.
