‘Cold’ infusion is brewing in the tea industry with a director, ‘Wa-Susana’ being shut out of his offices.

The high court agreed with John Muthamo-Wa-Susana’s other directors on a decision they held was based on disciplinary grounds.

Wa-Susana told the court however that the decision was influenced by members of the Kenya Tea Development Authority.

Wa-Susana was locked out of his office on August 19, last year, through a resolution by his six co-directors for alleged breach of the firm’s Code of Conduct.

The decision was formally communicated to him on August 23, last year.

Justice Joseph Sergon threw out assertions by Wa-Susana that his colleagues did not have any legal authority to make such a resolution.

He claimed that the plot to kick him out was engineered by KTDA.

He said that decision was baseless, malicious and high-handed.

The court noted that KTDA was an appointed managing agent of Ndima Tea Factory and was legally protected against any punishment regarding disciplinary action taken against Wa-Susana
