National Assembly which intends to debate a petition seeking to remove Auditor general Edward Ouko.
BY SAM ALFAN.
Activist Okiya Omtyata has filed a suit seeking to suspend the National Assembly from debating the removal of the Auditor general Edward Ouko.
Okiya claims that the proceedings before the National Assembly are a charade and a mockery of the constitution.
He further argues that contrary to the principles of the natural justice and clear provisions of the constitution, Edward Ouko is being subjected to double jeopardy since the DPP cleared him most of the charges as he is supposed to defend himself before the committee.
“The deliberate violation of the rights of the auditor general to a fair trial and to a good reputation must not be allowed to continue,’’Omtatah argues.
In the petition filed at the Milimani law court, the petitioner claims that there has been a campaign by senior members of the executive and the legislature to harass and remove Ouko from office adding that the auditor general is a marked man for diligently performing his duties under the law.
Okiya says that to have Ouko answer fresh charges which he was cleared of undermines the authority of the office of DPP.
The petition filed by lawyer  Mwagambo seeks to have  Ouko sacked on grounds of violating the Constitution by allegedly failing to submit yearly reports to the House and the President, and using his position for procurement malpractices.
According to Omtatah, there is a plan to hound Mr Ouko from office over his audit on the Eurobond scam since he has been publicly accused of making it suit a certain political interest.
Proceedings to resume Next Week.
