A citizen has filed a case seeking universal voting for Prisoners.
Shadrack Kinyanjui Wambui through lawyer Danstan Omari want prisoners to vote for their members of parliament, governors, women representative, senator and member of the County Assembly in the coming general elections.
“I have filed a petition asking the court to declare that the directive by IEBC denying sane prisoners the opportunity of electing their preferred candidate position of Governor,Senator,Women Representative and Members of County Assembly in the August 8, general elections is illegal and unconstitutional” said Kinyanjui in his affidavit.
Mr Kinyanjui a Catholic University of Eastern Africa trained lawyer,
argues that all prisoners of Kenyan Nationality are entitled to the enjoyment of all rights, privileges and benefits provided in the constitution.
He further argues IEBC has an obligation to observe respect,protect and fulfill the prisoners right and more to facilitate their right to register and to vote.
The prisoners are allowed to vote for only for their preferred presidential candidates.
The matter was certifies as urgent .The petitioner was directed to serve the IEBC, Kenya Prison and National Police Service.
Proceedings to resume on 1 of March for further directions.
