NYERI GOVERNOR IN TROUBLE FOR RETAINING LATE GACHAGUA’s EXECUTIVE COMMITTEE MEMBERS.

Governor Samuel Wamathai is facing the first battle as the Nyeri Governor over his  decision to inherit the late Governor Gachagua nine County Executive Members.

This is after three residents of Nyeri County moved to court on Wednesday seeking the removal of nine members of the Nyeri County executive from office.

Mr Bernard Ngiri, Denning Omungo and Catherine Wangui in their court documents argue that allowing members of the former County Executive Committee of the late Governor Nderitu Gachagua to act as members of the County Executive Committee of the current Governor Wamathai without the approval of the members of the County Assembly, makes it clear that the current County Government is unlawful.

They now want the court to issue interim injunction pending the hearing and determination of the application that’s challenging governor Wamathai decision to retain the late Governor county executive committee members.

The three claims that the death of Governor Gachagua Nderitu effected an automatic constitutional operation whereby the members of the County Executive Committee appointed by the late Governor Gachagua Nderitu ceased to hold office.

“It is the current Governor of Nyeri to make new appointments of the members of the County Executive Committee , be it new appointees or reappointments of those in the office with the approval of the Members of the County Assembly of Nyeri, ’states the petition.

 

It is their argument that the County government of Nyeri and the the governor Wamathai continue to neglect and ignore the provisions of the constitution by allowing unknown persons to hold office without approval of the Members of County Assembly of Nyeri.

The court directed that the matter be transferred and heard before the Nyeri High court.
