Former Chase Bank chairman Mohamed Zafrullah Khan Accused of conspiring to defraud the bank over Sh 1.6 billion will continue being held in prison remand after failing to raise a total of Sh 60 million
bond term imposed to him by a Nairobi court.
Zafrullah has been in custody since last Tuesday will still remain held at Industrial area Prison until Wednesday when the magistrate will deliver her ruling on his application to reduce the previous bond terms.
The accused was on Thursday granted bond following successful application by his lawyer Cecil Miller who informed the court that his client is not a flight risk.
Today Khan Lawyer Miller applied for review of the bond terms, saying his client has been unable to raise the surety imposed to him.
Miller presented several medical documents from US indicating that Khan was supposed to be attended by doctors. He told the court his client is very sick since he was remanded.
Senior DPP Warui opposed the application saying the medical document produced in court did not indicate the accused was seriously sick apart from partick which he said is a normal for a person of his status when he find himself in prison.
Last week Principal Magistrate Martha Mutuku ordered him to present two Kenyan sureties to deposit Sh60 million so as to secure his release.
The bond terms had been granted on the grounds that the High Court had issued orders that would have seen him given his passport so as to travel to the US for treatment in 30 days.
