Marianne Kitany’s lawyer has poked holes into the alleged marriage between Meru Senator Mithika Linturi and Mercy Kaimenyi.
Lawyer Danstan Omari, while cross-examining Father Jason Micheni, who is alleged to have officiated the said marriage, wondered why the priest solemnized the union while Linturi sired had two children out of wedlock.
The priest said he was not aware of the children saying: “I asked whether he had children and he did not disclose.”
Micheni, however, said had he known of it, he would still have presided over the marriage held at Tigania Catholic Parish church on April 8, 2000.
It was his testimony that he did not know that the lawmaker sired two children with his alleged first wife Susan Gaceri.
The court heard that under the Catholic Church canon laws, marriage to a person bound by natural obligation such as another party or children from a previous union shall not be conducted unless permitted by the Bishop.
The court further heard that after marrying Kaimenyi, Linturi had another child with a different woman before meeting Kitany.
The priest disputed that he knew Linturi had sworn an affidavit where he indicated that he was divorced and that he had indicated in the marital status in his university application in 2013 that he had separated with his spouse.
The witness further Chief Magistrate Peter Gesora that he did not know he was in court to testify in divorce proceedings.
When asked about the whereabouts of Kaimenyi he said he has been in contact with Linturi all these years and that he said he wa only aware that she is a teacher in Nanyuki.
