LAWYER WANTS MAGISTRATE MUTUKU OUT OF GETHINJI’S ASSAULT CASE.

City lawyer George Wajackoyah now wants Milimani Chief Magistrate Martha Mutuku to recuse herself from the alleged assault case facing former Tetu Member of Parliament Ndung’u Gethinji.

Magistrate Mutuku made the directive after the lawyer sought to have her disqualify herself from an assault case involving former Tetu MP Ndung’u Gethinji.

However, the Magistrate directed the lawyer to file a formal application seeking her recusal from the criminal case.

The lawyer is said to have written a letter to Milimani Chief Magistrate court seeking to have Mutuku to recuse herself from handling any matter to the former MP.

However, the MP who was expected to face assault and malicious damage to property charges did not plead to the same after the DPP Noordin Haji sought to differ the plea for two weeks to review the file.

During the court proceedings both Wajackoyah and Gethinji’s lawyers Ishmael Nyaribo and Bryan Khaemba had a bitter uttercation trading accusations against each other.

Lawyer Nyaribo accused Wajackoyah of seeing a letter he claimed has been written to Directorate of Criminal Investigations over the investigators in the matter.

He further accused Wajackoyah of having personal interest in the matter yet he is not a complaint in the assault case.

Wajackoyah dismissed the claims by lawyer Nyaribo claiming he is interested in the Kihingo estate matter.

The exchange in the court proceedings prompted the Magistrate to interject saying she is so disappointed in the behavior of the lawyers and apologized to the members of the public following the court proceedings.

Magistrate directed the matter to be mentioned on April 14 to allow the parties exchange their pleadings of an application for her recusal.

Gethenji, who is battling other criminal cases in court is expected to be charged with assaulting a security guard in Kitisuru as captured in a cctv footage in Kihingo village homes.

He is also engaged in civil suits over the control of a luxury home at Kihingo Village, Kitusuru.

The former lawmaker has since handedover his gun for ballistic examination at DCI offices.

During his arrested early this year, the police confiscated Gethinji’s firearm which is expected to be used as an exhibit before court.

The former MP is accused of assaulting a security guard Godfrey Mutua who was innocently performing his duties on February 5, this year after curfew hours.

The guard is seeking justice after he was allegedly hit with the gun by the former legislator.
