BUSINESSMAN IN COURT OVER ALLEGED FAKE TITLE.

A Nairobi businessman has been presented before a Nairobi court with obtaining a title deed to a parcel of land by false pretenses.

Abdirashid Abdul Sharifow alias Zainulabidin Sharif appeared before Milimani Chief Magistrate Francis Andayi but did not plead to the charges.

The businessman allegedly falsely obtained registration to the land by pretending to be the owner, an offence he allegedly committed between January 7, 2018 and June 29, 2020 at Ardhi House in Nairobi.

Abdul could not plead to the charge to allow the prosecution verify claims that he had obtained orders from Environment and Land court suspending the case.

His lawyer also challenged the charge sheet arguing that it was defective, since the person referred to in the charge sheet as alias is a known person with an identity card.

The charge sheet stated that Abdul Sharifow alias Zainulabidin Sharif willfully procured registration of title LR. NO. 209/3630 by falsely pretending to be a genuine and valid registered owner of the said property.

He is alleged to have committed the offence, jointly with others not before court at the Ministry of Lands Headquarters.

On the second count, Abdul is alleged that on May 5 this year at the Directorate of Criminal Investigations (DCI) Headquarters in Nairobi, with intent to deceive, he presented himself to Chief Inspector Wanga Masake as Zainulabidin Sharif and the registered owner of the disputed land.

The court ordered him to deposit cash bail of Sh100,000 or alternative bond of Sh200,000 to secure his freedom, pending the plea taking.
