Chief Justice Martha Koome has appointed a bench of three judges to determine two petitions challenging the decision by President Uhuru Kenyatta to reject the appointment of six judges.

James Wakiaga, George Dulu and William Musyoka heard the case on Monday and directed the two petitions to be consolidated.

The petitions were filed by Katiba Institute and Nakuru based surgeon Dr Benjamin Magare Gikenyi.

Last month, President Kenyatta appointed a list of 34 judges but left out six of them, from the list recommended by Judicial Service Commission.

The six judges are High Court judges Aggrey Muchelule, Weldon Korir, George Odunga and Prof Joel Ngugi.

President Kenyatta also rejected Mombasa chief Magistrate Charles Kinango and high Court Registrar Judy Omange.

The six were allegedly rejected over integrity issues..

In the cases, the petitioners state that the president acted against the constitution and in a biased manner.

High Court James Makau has since issued an order stopping the formation of a Tribunal to investigate the six.

The judge further has halted any investigations arising from the decision of the president pending hearing and determination of the Petitions.

The decision of the president was condemned by Law Society of Kenya and Judicial Service Commission urging to reconsider his decision.
