SCHOOL ORDERED TO PAY SCHOOL HEAD FOR ILLEGAL TERMINATION.

Nyandarua based Beverly School has been ordered to pay its former deputy principal and mathematics teacher Sh1.7 million for unlawful sacking.

Employment and Labour Relations Court Judge David Nderitu ruled that the termination of Titus Ndirangu on account of redundancy was illegal.

Justice Nderitu said, “A declaration be and is hereby issued that the claimant’s termination by the respondent on account of redundancy was unprocedural, unfair, and unlawful.”

Ndirangu was hired by Beverly School as Deputy Principal and a mathematics teacher on January 2, 2018 at a monthly gross salary of Sh100,000.

He testified that about one year later, on February 13, 2019, he was called to the office of the director and was issued with the letter of termination.

He quoted part of the letter that stated “Beverly school has had to make the tough decision to release you due to the fact that student recruitment and new admissions have remained below the necessary thresholds to sustain your continued employment at the school.”

The letter signed by the executive director Alice Mudiri said the termination was immediate and his dues would be calculated and paid in installments.”

And even after being fired, the school management failed to pay him as agreed but instead made staggered and irregular payments.

“The Claimant further stated that he demanded payment of the accrued salary arrears on numerous occasions but the Respondent did not yield”, says the court documents.
