KPA STOPPED FROM ENTERING SECURITY PROVISION DEAL WITH NEW FIRMS.

Kenya Ports Authority has been stopped from entering into a new agreement for provision of security companies at the port, pending the determination of a case filed before the High Court in Mombasa.

High court Judge Joseph Mativo suspended the intended conclusion, execution or implementation on any written or unwritten contracts for provisions of security services between KPA and any of the ten security firms, pending the determination of a case lodged by Newham Services and International ltd.

The court also prohibited the removal or eviction Newham Services and International ltd from the Port premises, where it currently provides security services in a contract executed in March 2018.

He court directed KPA to comply with regulations 74(2) of Public Procurement and Disposal Regulations.

The order bars KPA form entering into contract with Catch Security Links ltd, Hatari Security Guards ltd, Northwood Services ltd, Total Security Surveillance ltd, Bedrock Security services ltd, Sovit Security Solutions ltd, Security Links ltd, Access Security Links ltd, Radar ltd and Vickers Security Services ltd.

Newham Services and International says it is aggrieved by the KPA’s decision to award the tender for the provision of the security services in a deal dated January 28, 2022 notwithstanding the hearing of an application for Review before the Public Procurement Administrative Review Board.

The company says it has filed a request for review before the board against KPA’s decision made on January 28, 2022 rejecting its bid on the ground that the company provided table content that does not clearly indicate sections and page numbers.

It is also alleged that the firm did not provide complete set of audited accounts for the last three years 2018, 2019 and 2020 which grounds are false, untrue and illegal.
