A city businessman has been charged with obtaining Sh44 million from a company pretending to be in a position to secure a tender from a government institute.

Duncan Wanga Ambuche appeared before Milimani Chief Magistrate Susan Shitubi facing charges of conspiracy to defraud.

The court heard that he fraudulently obtained the millions while pretending that he was in a position to secure for Shuria Construction Company, a tender at Bukura Agricultural College in Kakamega county.

Ambuche is alleged to have committed the offence on diverse dates between August 14, 2020 and September 28, 2021 at Queensway house along Kaunda Street, in Nairobi.

The court heard that Ambuche conspired with intent to defraud the Company the millions by issuing a forged award, purportedly issued by the Principal of Bukura College.

In addition, Ambuche was charged with uttering a false tender award notification letter dated December 18, 2020 for the proposed construction of a wall on December 21, 2021.

He was released on a cash bail of Sh 100,000.
