The family of the late rally ace Asad Khan has demanded for thorough investigations into the cause of his death.

Through city lawyer Cliff Ombeta, the family demand to be allowed to participate in the investigation and assist the police by pointing out key areas that will help unravel the case, which has since shifted from that of assault to murder.

Fellow rally driver and lover Maxine Wahome had been arrested over assault but she was released on bail.

The prosecution later said the matter has since shifted to murder after Asad, popularly known as Kalulu passed on while undergoing treatment.

Maxine Wahome is the daughter to Kenya retired rally driver Jimmy Wahome.

Lawyer Ombeta said sleuth needs to cover more angles before deciding on whether to charge Maxine with murder or prefer an inquest.

Lawyer Ombeta said detectives needs to record statement from initial responders, collect data from mobile phones provider for the suspect and family members.

He added that details from the Uber used by Maxine (if any), DNA from suspect among others things should be covered.

“Khan family feels those details have not been covered or not properly handled,” Ombeta told the court.

Lawyer Ombeta dismissed concerns raised by Maxine’s lawyer over the participation of the victim’s lawyer in the matter.

Ombeta said the victim’s family were no longer passive or mere spectators in the criminal justice system.

“Victims act gives them right to participate actively. Counsel for the suspect cannot ask the victims to be silent when they raise issues with the investigations or lack thereof,” Ombeta told the court.

Lawyer Ombeta told the court that the victim family has raised issues because they have realized probably there angle that has not been covered.

“We are not the one investigating, we are just asking can those angles be looked in to,” said lawyer Ombeta.

Senior principal magistrate Benard Ochoi noted that having closed the earlier investigation file, the police focus now shifted to establishing those behind the murder of the rally driver.

The court directed Maxine to keep reporting to the Kilimani DCI every Thursday and record a further statement.

She was also asked to cooperate with the investigating officer until January 30, when the matter will be mentioned.
