Former Nairobi governor Mike Sonko has defended a move by a city court rejecting to admit uncertified bank statements in a graft case against him.

Through his lawyer Asa Nyakundi, Sonko told High Court judge Nixon Sifuna that the rejection of the statements was within the purview of the law.

Senior counsel Nyakundi further told Justice Prof Sifuna that the trial magistrate could not admit the bank statements issued by Equity Bank because they had not been certified.

The lawyer added that the officer who gave evidence from the bank concerning the nine bank statements was not even the maker of the certificate nor did he produce the original bank statements.

He said the court was shown were copies that were electronically generated.
Nyakundi said trial magistrate Peter ooko exercised his powers as required by law by rejecting the bank statements.

The court was informed that the application for revision of the decision of the magistrate does not hold water, but a waste of time and prosecutions should have waited until the final judgment, so as to appeal against it.

He urged the judge to find and hold that the application lacks merit and dismiss it.
The court will rule on the application on July 5, 2023.
