Two men have been found guilty of being in possession of Improvised Explosive Devices (IEDs) including seven projectile bombs for the purpose of committing a terrorist act.

Abdimajit Hassan Adan and Mohamed Osman Nane were convicted of nine counts related to terrorism.

Milimani senior resident magistrate Zainab Abdul said in a ruling that the prosecution had proved that the two were found with 36 hand grenades, rounds of ammunition and five specified firearms including AK47 rifles, on February 15, 2018, in Merti, Isiolo County.

The charges stated that the accused persons intended to bomb the Milimani law courts.

Adan and Osman had been charged alongside Anthony Kitila Makau alias Rasta, John Maina Kiarii (Deceased), Lydia Nyawira Mburu and Francis Macharia Karishu.

They were arrested in 2018 and charged with conspiracy to commit a terrorist act, possession of weapons for terrorist purposes, forgery of documents among other charges.

Nyawira was found guilty of forging an identification card bearing the name of Jirma Huka Galgalo, one of the accused persons who is now deceased.

The court said did not in any way defend herself from the charge of forgery during cross-examination.

Kitila was acquitted of the charges as the court stated he was not involved in aiding to conduct any terror activities.

The court also acquitted Macharia stating that being the owner of the shop in which the forgery was taking place, he was not often in the office hence did not have any hand in forging the documents.

The court ordered Assan and Osman to be remanded at Kamiti Maximum prison awaiting sentencing while Nyawira will be held at Lang’ata women’s prison.
