The Judicial Service Commission (JSC) has petitioned President William Ruto to form a tribunal to investigate the conduct of Judge Mohammed Noor Kullow over gross misconduct, incompetence and violation of judicial code of conduct.

The judges’ employer said a committee that investigated complaints against the Environment and Land court judge and the probe disclosed grounds for removal of a judge.

The JSC added that five complaints were filed against Justice Kullow but two were dismissed.

According to JSC statement, the commission initiated the removal proceedings against Justice Kello from office for inordinately delaying or failing to deliver rulings or judgment in total 116 judgments and rulings.

The commission at the same time sacked Principal Magistrate Patrick Wambugu.

The magistrate was accused of irregularly altering bond terms that resulted in the release of an accused person, who had been charged with defilement of a six year old minor.

The accused person jumped bail.
The commission revealed that it received 85 complaint in the past one year against judges and 37 of them has been dismissed on the grounds that they were based on merits and decisional independence of the judges.

Thirty of the complaints are pending preliminary evaluation before the commission while 11 others are awaiting responses from concerned judges.

The statement further indicate that three petition have been admitted for hearing and four petition have been forwarded to the president for appointment of Tribunal to remove them.
