GOVERNMENT ACCUSES FORMER CBK GOVERNOR OF INFLUENCING OUTCOME OF TATU CITY CASE.

The government has objected a request by former CBK Governor Nashon Nyaga to have majority  shareholders in Tatu City project charged with fraud.

Through the office of the Director of Public Prosecution Keriako Tobiko the state says that the former governor is trying to exalt pressure to gain mileage in the case.

A senior state counsel Edwin Okello told  the court that an application by Mr Nyaga is aimed at exalting pressure on the government to act contrary to the provisions of the law.

Nyaga has sought a disclosure of the report by DCI which  allegedly recommended the prosecution of Mr Stephen Jennings and Richard Reid.

However the DDP told Justice Joseph Onguto, that such disclosure would be highly prejudicial and  will undermine the  ongoing investigations.

The DPP received two  files, he can’t be asked to  disclose the content of the recommendations before making a decision as to whether he can press charges or not.

Mr Okello told the court that the DPP has since recommended the prosecution of Nyagah and his two lawyers Mr Nelson Havi and Michael Osundwa.

An order has been issued stopping their prosecution.

He said that two inquiry files are before the DDP in respect of the rivals group companies, Satum Properties limited and Kofinaf company limited.

They are currently under scrutiny by a multi agency team.

Mr Okello said the DDP is yet to make a decision on the  matter and should not be pressured to do so.

SC Ahmednassir Abdullahi added that the application by Nyaga is designed as a collateral attack since half of if is touching on his personal character.

The court will deliver a judgement on October 31 2016.

Proper nutrition prior to conception and during pregnancy can help prevent birth defects, here’s how.

Birth defects, which are structural or functional abnormalities present at birth, result in physical and mental disabilities. They are also the leading cause of death in infants less than 1 year of age. With proper maternal nutrition or dietary supplements both prior to and during pregnancy, some of the thousands of types of known birth defects can be prevented.

The Maternal Diet and Birth Defects

A lack of vitamin B9, more commonly known as folate (or its synthetic form, folic acid), in the mother’s diet can lead to neural tube defects in infants, Neural tube defects, such as spina bifida andanencephaly, are developmental problems with the brain and spinal cord, which usually begin during the first trimester of pregnancy. In an infant with spina bifida, the spinal column does not completely close, resulting in nerve damage and paralysis of the legs. With anencephaly, infants usually do not survive because much of the brain fails to develop.

Getting adequate amounts of folic acid both prior to and during pregnancy, especially during the first trimester, prevents most neural tube defects. The Dietary Recommended Intake (DRI) for folic acid is 400 micrograms (mcg) per day, either from a multivitamin or from foods that contain folate, the natural form of folic acid. Foods high in folate include leafy green vegetables, fortified grains and orange juice, dried beans, peas, and fruits.

Another vitamin that is essential in the prevention of neural tube defects is vitamin B12. The DRI for  for women is 2.4 mcg per day and 2.6 mcg per day during pregnancy. Good sources of vitamin B12 are milk products, meats, poultry, and eggs. Just as with folic acid, women need to meet their vitamin B12 needs prior to conception as well as during pregnancy to lower their risk for neural tube defects. Women who are most likely to have low vitamin B12 levels are those who have intestinal disorders that impede absorption of vitamin B12 and those who eat little or no meat, eggs, or dairy products.

Women with poor or restricted diets are also at risk for delivering babies with neural tube defects ,The mother’s caloric intake is extremely important because the needs of the baby are so high.

Other conditions caused by improper diet include:

Congenital heart disease: Pregnant women who have a diet low in riboflavin (vitamin B2) and niacin (vitamin B3) are at risk of having babies with congenital heart disease, especially if they eat diets high in saturated fats. Dairy products (low-fat or fat-free to avoid saturated fat), liver, and green leafy vegetables are good sources of vitamin B2, and vitamin B3 can be found in chicken, fish, liver, nuts, and whole grains.

Gastroschisis: A poor pregnancy diet is a contributing factor for gastroschisis, a birth defect in which the infant’s abdominal wall has a fissure or tear. Women who have a diet low in protein or zinc and who have a low body mass index (BMI) are at risk for having an infant with gastroschisis. Inadequate nutrition and smoking during pregnancy can also cause gastroschisis.

Congenital diaphragmatic hernia (CDH): Women whose diets are low in vitamin B12, vitamin E, calcium, retinol, and selenium are at risk for having a child with congenital diaphragmatic hernia. CDH is characterized by an opening in the infant’s diaphragm resulting in the contents of the abdomen protruding into the thoracic cavity. Taking vitamin supplements greatly reduces this risk.

Cleft palate: A cleft palate is a birth defect in which the roof of the mouth does not completely close during development. Women on a restricted diet or who aren’t getting the proper nutrition have a chance of delivering a child with cleft palate. A lack of folic acid and vitamin A in the mother’s diet are associated with isolated cleft palate (without a cleft lip).

Fetal alcohol syndrome (FAS): I highly caution that pregnant women should avoid alcohol to prevent having a baby with fetal alcohol syndrome (FAS). Babies born with FAS are smaller, poorly developed, and have lifelong problems.

Maternal Diet and Birth Defects: How Prenatal Vitamins Benefit Baby

Getting the proper amounts of nutrients is very important for both mother and baby. Prenatal vitamin supplements can provide the needed amounts, iron and calcium supplements are especially important for the developing baby. A poor diet not only increases a mother’s risk for birth defects, but also contributes to premature births, pregnancies that do not go full term, and high-risk pregnancies.

NUTRITION is very important. Women who are pregnant need to remember they’re eating for two, and plan their diet around the health of their baby.

THREE STEAL PHONES WORTH SH30 MILLION FROM DEPUTY PRESIDENT’S OFFICE.

Three people have been charged with stealing mobile phones worth over Sh30 million from Deputy President William Ruto’s office.

They were intended for use in the just concluded TICAD conference in Nairobi.

Martin Mwangi Njeri, Betty Wangui Nderitu alias Jennifer and Felix Kipyegon Langat appeared before senior principal magistrate and denied the charges.

They face several counts of conspiracy to defraud and faking documents from the Ministry of Foreign Affairs and International Trade.

It is said that they faked a tender document to supply and deliver iPhones,.

It is alleged that the accused purported to have been authorized by the state to conduct business on its behalf by supplying the phones to delegates attending Tokyo International Conference on African Development (Ticad) in Nairobi.

The suspects are said to have conspired to defraud Capital Airtime Limited 200 pieces of iphones valued at Sh 19,740,000 claiming that they had won a tender supported by the fake purchase order from the Ministry.

The prosecution requested the court to deny the accused bail saying investigations are still ongoing.

The phones are said to have been stolen from the office of the deputy president by thid suspects posing as government officials.

It is alleged that two weeks prior to the TICAD conference, the supplier visited the Deputy President’s office and was shown the LPO purported. The supplier then released 200 iPhones valued to nearly Sh30 million to the suspect.

Police are still trying to unearth the mystery of how the accused accessed a government vehicle and managed to gain entry into the offices of the deputy president and the foreign affairs ministry unnoticed.

They were released on a cash bail of Sh 1 million each or a bond of Sh 3 million.

Proceedings resume tomorrow.

A young man accused of touching the buttocks of a female police officer with his private parts has been ordered to pay a sh30, 000 cash bail.

Barber David Munene Kathurima, 24 appeared before Senior principal magistrate Joyce Gandani where he was accused that on September 10 2016 at downtown Nairobi, Duruma road,he intentionally touched the buttocks of 22 year old police constable Sheila Achieng Oloo with his genitals against her will.

Kathurima who denied the charge pleaded with the court to reduce his bail from Sh50,000 saying he could not raise the amount.

On the September 10 2016 at around 13:00hrs the complainant police officer Sheila Ochieng Oloo was on patrol in police uniform with her colleague Senior officer PC Jackson Ndirangu she went to a nearby M-pesa shop to withdraw some money.

Kathurima suddenly came from behind and held her and pushed his genital on her buttocks ad she fell on the counter of the M-Pesa shop.

She turned around and saw the accused and asked him what was the problem and the accused answered her that “Kenyan law don’t operate nowadays” do not take the law with your own words” replied the accused.

The accused who had bought yoghurt from the same shop started pouring the yoghurt on the two officers as he hurled insults on them.

He also resisted arrest by the officers.

It was said that he wrestled with officers while resisting arrest but the two officers were helped by traffic officers who arrested him and pushed him into a waiting police land cruiser and took him to central station where he was detained until today.

FORMER PRESIDENT KIBAKI’S PARTIES FIGHT FOR CONTROL OF ASSETS.

Two parties that collaborated to put retired President Mwai Kibaki at the helm of Kenya’s leadership are now engaged in a fierce war over their assets.

National Rainbow Coalition Kenya (NARK KENYA) a party led by former Gichugu MP now a presidential aspirant Martha Karua has moved to court seeking orders to block PNU from selling its assets.

The Party for National Unity was the vehicle used by President Mwai Kibaki to seek re-election in 2007.

In a certificate of urgency, NARK Kenya Secretary General Dr Ambrose Nzomo accuses PNU secretary general of publishing a notice calling for PNU’s Governing Council to dissolve  and wind up the party.

Narc says that the move contravenes the provisions of section 48(1) of the political partied Act, 2012.

“NARK Kenya is a fully registered political party and through its coalition partner-PNU, Nark Kenya is eligible and qualified to various shares of monies from the political parties Fund, “Nzomo argues.

Nark Kenya says that PNU have kept all its benefit including monies adding that the said decision is unjust and discriminatory.

PNU was formed in 2007 by an alliance of 7 political parties, NARK Kenya being among them.

The IEBC, Registrar of political parties, among others have been listed as respondents.

Since researchers first describedSTEOPOROSIS in the early 1940s, much has been learned about bone loss and how to prevent it. Osteoporosis is a disease that results from bone loss, or the loss of bone density and tissue. It is normal to lose some bone density as you age, but some people are at risk of losing a greater amount than others and developing osteoporosis. Fortunately, you can help lower your risk of bone loss by eating a diet rich in the nutrients that keep your bones healthy and strong. They include:

  1. Calcium

Calcium is essential for healthy bones. The body uses and loses calcium every day. If more calcium is lost than is replaced, bone loss occurs.

Because the body does not make calcium, you must get calcium from the foods you eat. The amount of calcium needed in your diet every day is 1,200 milligrams for adults over 50 years old; 1,000 mg for adults ages 19 to 50; and 1,300 mg for children ages 9 to 18. However, most people get only half the recommended amount, or about one and a half dairy servings per day, Additionally, Women age 20 and over average only slightly more than one serving of dairy foods per day.

Dairy foods are rich sources of calcium, Milk, yogurt, cheese, and frozen desserts are popular sources of calcium with 300 mg or more in a one cup serving. Dairy foods with lower fat and water content are more concentrated sources of calcium. Dairy foods also provide another nutrient;phosphorus, needed to work with calcium.

Some vegetables, like leafy greens, contain 150 to 270 mg of calcium a serving. Other sources of calcium include:

  • Sardines and salmon.
  • Almonds
  • Calcium-fortified foods such as orange juice and cereals

If you can’t eat dairy foods because of lactose intolerance i recommend trying different dairy products to see if some give you less trouble than others. For instance, yogurt might not bother you the way milk does. If you find that you can’t get enough calcium from the foods you eat, a daily supplement may help you get your minimum

  1. Protein

Protein is the next most important nutrient for bone health, Good sources of protein are:

  • Meats, poultry, and fish
  • Nuts and seeds
  • Dairy products
  • Dry beans and peas
  • Eggs

Because both low- and high-protein diets can affect your body’s ability to best use calcium, eating protein in moderation is your best bet. The protein requirement for women age 19 and over is 46 grams per day; it’s 56 grams per day for men of the same age.

  1. Other Nutrients for Strong Bones

Vitamin D is necessary for calcium absorption and consequently to prevent bone loss. The daily recommendations for vitamin D are 400 to 800 International Units (IU) for adults under age 50, and 800 to 1,000 IU daily for adults age 50 and older. People may be able to meet their vitamin D needs by getting at least 15 minutes a day of sun exposure. If you’re housebound or live in a colder climate, you may benefit from taking daily vitamin D supplements of 400 to 600 IU. If you drink milk for the calcium, you may also be getting vitamin D because it’s usually added to milk; other food sources are egg yolks, saltwater fish, and liver.

Magnesium, zinc, copper, iron, fluoride, and vitamins A and C are also required to prevent bone loss. Eating a well balanced diet that includes plenty of fruits and vegetables, whole grains, meats, beans, nuts, and seeds helps ensure that you’re getting what you need.

The Food vs. Supplement Debate

Getting at least the minimum recommended amount of needed nutrients every day is most important in maintaining healthy bones and preventing bone loss and osteoporosis.I advise that you try to get your nutrients from food rather than relying on multi-vitamins. If three or four servings of dairy foods just do not fit into your daily diet, a multi-vitamin will provide about 400 IUs of vitamin D.I also recommend taking a separate calcium supplement because calcium can interact with other nutrients.

Get to know the nutrients necessary in preventing bone loss, and make sure your diet is serving up sufficient portions of vital bone-building foods.There you have it.

A 60 year old man’s hopes to be identified as a son of fallen Hero former Minister William Ole Ntimama have been dashed by the court.

He wanted the High Court to stop the burial of former minister saying that the deceased is his beloved father.

George Kariuki Njoroge who wants to be referred as George Kariuki Ntimama said that his father had a relationship with his mother Rebecca Ngibia Wanjiku now deceased which relation bore the seed which is him in 1956.

Kariuki said that Ntimama left his mother after she got pregnant.

He wants the court to allow him extract a tissue specimen from the deceased’s body to enable him conduct a DNA test to affirm his claims.

He further wants the court to issue temporary injunctions stopping Kilimani local chief from issuing a burial permit and Lee funeral home from releasing the body for the forthcoming burial.

Kariuki Ntimama told the court that he learnt that he is a son to the former minister in 1998 from his late mother.

“I was very curious to know who my father was, because people kept on telling me that i resembled Ntimama who i only used to see on television,” he said.

Ntimama died last Thursday night in his sleep at his Melili home in Narok county.

He said he never talked about the matter for he feared hostility from Ntimama’s immediate family members.

He said he is not decided on whether to attend “his father’s burial” for he is not certain how his extended family will receive him.

He is afraid that if the court hesitates to issue the orders he is seeking, his late father will be buried and he will lose out on his “father’s” property and continue being sidelined.

In a landmark decision delivered by the high court, men who sire children out of wedlock should be allowed to have the surnames of the biological fathers.

NACADA boss John Mututho is safe for now after the High Court reinstated him as the anti-narcotics chief.

The desire to send him home had been reached by Interior Cabinet Secretary Major Gen. (Rtd.) Joseph Nkaissery.

High Court Judge George Odunga ruled that Mututho has presented an arguable case before the court and as such should be heard before being condemned.

Mr Mututho in his application claims that in a letter dated September 6, 2016 CS Nkaiserry purported to retire him on grounds that he has been appointed Chairman of the Transport Licensing Appeals Tribunal.

He says that the purported retirement is malicious adding that even Kenyans know he he has been leading in  fighting corruption at the Authority thereby killing drug cartels.

He Further states that CS Nkaiserry failed to comply with the law  and has not been given a procedurally fair administrative action.

Mututho believes the decision to retire is a witch-hunt which is a consequence of his corruption claim against officers attached to the Authority to the Ethics and Anti-Corruption Commission (EACC).

Those officers are currently facing charges in court where he is one of the key witnesses.

Proceedings resume October 4.

CHINA CONTRACTOR GIVEN SH66 BILLION TENDER CHARGED OVER TAX EVASION.

A Chinese Contractor who won a Sh55 billion tender to make a Green Field Terminal at JKIA has been charged with tax evasion.

The controversial tender was cancelled.

Hongyou Huang, alias Yellow, who is the vice President of China National Aero-Technology International Engineering Corporation, appeared before Milimani chief magistrate Daniel Ogembo and denied the charges.

The prosecutor says that between May and June 2014, the accused jointly with others not before court, failed to pay taxes amounting to more than Sh66 million being the company manager.

His other three companies, the prosecutor adds were liable to pay income tax but failed to file tax returns with the Kenya Revenue Authority between 2013 and 2014.

The accused also faces another count of failing to appear before KRA on May 4, this year despite having been duly notified to do so.

The prosecution asked the court to enhance Hongyou’s Sh50,000 bond terms, saying the charges he is facing are serious and carries a fine of double the amount of tax evaded or imprisonment of 10 years.
He was also described as a flight risk.

Through lawyer Ian Maina, the Chinese dismissed claims that he is a flight risk, saying his abode is known to police, adding that he has lived in Kenya for more than 22 years. The magistrate, however, granted the prosecution application and reviewed Hongyou’s bond terms to Sh5 million with a Kenyan surety of a similar amount or a Sh1 million cash bail.

CM Ogembo further directed the accused to deposit his passport with the court.

Hongyou was arrested in June over tax evasion claims after his company was embroiled in controversy over the cancelled Green Field terminal project and before the launch of the new terminal 1A and E at the Jomo Kenyatta International Airport.

The Chinese firm won the contract to design and build the facility at the airport but the contract was cancelled in March.

President Uhuru Kenyatta said the infrastructure put up by the accused company after the international arrivals terminal was destroyed by fire in August 2013 was sufficient to meet the needs of passengers who transit through Nairobi.

Proceedings resume November 22.
