In his application MP Patrick Makau was seeking anticipatory bail saying that he did not take part in the demo, where an Ap ‘s camp, sealed as a no go zone was set ablaze.

He says that he only participated in a peaceful demonstration that was authorized by the Police .

“The applicant has surrendered himself to the police, he is within the court precinct ,the prosecution indicates that after being processed ,he will be charged as investigations have been completed” said judge.

However, the Dpp objected to his plea saying that he went into hiding and could not be traced at his residence.

He also told the court that the MP used his  position to influence locals to burn the camp where crucial evidence on the abduction and last moments of lawyer Kimani, his client and a taxi driver were traced.

According to a charge sheet presented in court,  it is alleged that on 6 th July 2016 at Syokimau AP Post in Machakos county with others not before court Makau set on fire Syokimau administration police post container,AP”s service police uniform, four wooden beds, four mattresses and assorted properties all valued at 500,000 shillings.
