For contesting National Assembly Majority Leader Aden Duale’s win, Farah Maalim will pay Sh6 million.
This is after the High Court upheld the election of the Jubilee firebrand MP for the Garissa Township Member of Parliament.
Justice Hedwig Ong’udi dismissed all the allegations raised against Aden Duale and said he was validly elected.
The court noted that there were no irregularities or malpractices that can annul the said election and the evidence provided was insufficient.
Justice Ong’udi issued judgment on four issues among them whether the Garissa Township Member of Parliament election was conducted in accordance with the law.
On this the court said that the IEBC conducted the said election in accordance with the elections laws.
On whether there was malpractices, the court said that the petitioner failed to prove the said allegations beyond reasonable doubt.
On allegation that Duale bribed the voters, the court said that the petitioner failed to link Duale to the bribery allegations.
The court also dismissed Maalim claims that IEBC employed partisan agents who even campaigned for Duale.
The judge said that allegations by the former MP had no basis and therefore dismissed the claims.
The judge also dismissed allegations that there was voter influence in the August 8 election.
