High Court has decline to stop the intended demolition of Ukay center.

However, Lady Justice Winifrida Okwany certified the application urgent and directed it to be heard during by the vacation judge next week.
This is after proprietors of UKAY Center moved to court seeking orders to halt the intended demolition of their premises in Nairobi in view of threat issued by Nairobi County Government.

Kental Enterprises limited, through their Lawyer Greg Karungo, says there is a serious threat to have the premises brought down any time now and the court should issue a conservatory order to restrain the County government, National Environmental Management Authority, Water Resource Management Authority and the Attorney General from taking action has intended.

Kental Enterpises say that the Nairobi County goverment approved the construction of the mall in 1984 on the basis of biulding plans by they submittted.

In an affidavit Sworn by Bimal Shah,he says that the mall was built with the approval of the Nairobi County Government and other state agencies.

The lawyer says that said property is locate LR No 209/11307 and LR No 209/11308 all owned by the petitioner.

The applicant want to argue case and court makes a determination before any action is taken by the respondents, the lawyer says.

The vacation judge ordered parties be served and come back for inter parties hearing on 14 of this month.
