MAN ACCUSED OF KILLING STAREHE MP MAINA KAMANDA AGENT TO FACE MURDER CHARGES.

The prosecution intends to prefer murder charges against a suspect accused of killing an agent of Starehe Member of Parliament Maina Kamanda.

The court heard that the suspect, Daniel Kuria Ngariu confronted a group of other young men who were pasting posters for Kamanda on walls of buildings along Juja Road at around 6.00 am on April 26 2017 and attacked one George Ndege.

The court further heard that Kuria was in a group that was pasting posters for Pangani MCA Peter Wahinya Njau.

“The group of attackers were alleged to be armed with pangas and knives at the time of the attack.During the attack George Ndege suffered injuries on the chest and lower jaw, another victim Peter Muchiri was cut on the right lower leg and as Ndege was fleeing from the attack crossing the other side of the road he was hit by an oncoming mini-bus Reg. no KBY 839G,” an affidavit sworn at the Milimani court by an investigating officer Sgt. Charles

The two victims were rushed to hospital where Ndege was pronounced dead,the court heard.

Police are now asking for 10 days for the suspect to be remanded at Pangani police station to identify and detain a motor vehicle that was used in ferrying the attackers and record witness statements among other investigations.

Ndege and colleagues were in the campaign team allied to Maina Kamanda’s Starehe parliamentary re-election, prosecutor Catherine Mwaniki said.

Police officers arrested the suspect after a complaint of murder.

HIGH COURT FREE BISHOP MARGRET WANJIRU ON A CASH BAIL OF 100,000

High Court has  freed Bishop Margaret wanjiru this afternoon been granted a cash bail of 100,000 shillings.
 
This is after she moved to the higher court under a certificate of urgency through his lawyer Kennedy Ochieng saying that the magistrate court erred in law by detaining her for five days in police custody.
 
Judge Ngenye Macharia directed that the application be served upon the DPP for inter party hearing on the 10th of May this year.
 
Wanjiru filed a review of the magistrate orders arguing that the orders infringes on her fundamental rights .
Wanjiru who was charged with creating disturbance contrary to section 95 (1)(b)of the penal code argued that her rights to fair trial was infringed.
“The applicant is hereby set free upon payment of cash bail of 100,000 shillings,court ruled.”

Nairobi Court yesterday detained Bishop Margret Wanjiru for five days.

Chief Magistrate Francis Andayi directed her to deposit a cash bail of 500,000 and 2 sureties after five days.

“A situation where there’s a threat of witnesses cannot be wished away. And in these case the prosecution told the court key witnesses runaway during the incident and they are yet to be traced and interest of justice will be well served if the court denies bail” said Magistrate.

He further said that though both offences are misdemeanors threat of violence during elections in Kenya is not something to be wished away.

This morning police sought Bishop Margaret Wanjiri detained in police custody pending hearing and determination of a criminal case.

According to affidavit by Corporal Shadrack Mbila of Directorate of criminal investigation, the Jubilee governor aspirant was accompanied by a crowd of about 50 people who were rowdy and chaotic and stormed city park polling station in Parklands-Nairobi County.

The court heard that due to fear and apprehension the clerks fled from the scene .due to the tension. The court further heard that the said polling clerks are yet to be traced.

“The accused person is an influential member of the society and there is high possibility of the accused to influence and intimidate the potential witnesses who are yet to record statement.

Shadrack said investigations are still being conducted against Margret Wanjiru and others who are not before court, and there is a likelihood that more charges are going to be preferred against her.

“The charge of malicious damage is a very serious offence that attracts a very severe sentence and therefore the accused is at flight risk” said affidavit.

Two United States of America nationals have been jailed for three months by a Nairobi Court.

They were further ordered to pay 50,000 Kenya shillings or serve three months imprisonment.

The two are American nationals pleaded guilty to charges of smuggling human being.

Fortune Osman Abdi is accused on 24 day of April at Kenyatta International Airport in Nairobi, being a United States of America national holder of passport number 460082704, you were reasonably suspected to be involved in smuggling one Amina Ibrahim and Abdiaziz Aden Farah.

Another accused known as Miss Fortune Farah Aden who is also accused of human smuggling.

She is alleged to have committed the offence at Kenyatta International Airport.

It is alleged on 24 of April 2017 at JKIA, being United States of America national holder of USA passport number 484302502, you were reasonably suspected to be involved in smuggling one Amina Ibrahim and Abdiaziz Aden Farah.

Fortune Osman Abdi told the court she is a mother of two and she is was pregnant.

They appeared before a Nairobi Principal Magistrate Kennedy Cheruiyot who ordered their repatriation to country of origin after serving their jail term or upon payment of their fine of Ksh 50,000.

Nairobi Carlcare Services limited Director has been charged with three criminal counts.

Mr Wang Haojie was charged with failing to comply with terms and conditions imposed by a work permit contrary to section 53(1) (1) of the Kenya Citizenship and immigration Act, 2011 laws of Kenya.

The offence was committed on April 24th 2017 at cardinal Otunga plaza within Nairobi County being a Chinese national with a work permit allowing him to work with Sino-Kenya Engineering Services, he was found engaging in employment with Carlcare services as a director in contravention of terms and conditions imposed by his work permit.

The accused was also charged with two counts of employing persons whom he knew or had reasonable cause to believe is committing an offence in engaging in such employment.

The prosecution alleges that on April 24th at Cardinal Otunga plaza in Nairobi County being a Chinese National and Director at carlcare services limited employed one Shu yi as a marketer and Liu Fei as a digital personnel in the said company knowing or having reason to believe he was committing an offence by engaging in such employment.

The case will be mentioned on May 29th and will be heard on June 20th.

GOVERNORS BID TO ALLOW PARTY HOPING FLOPS.

The High Court has dismissed a petition by Council of Governors seeking to stop implementation of section 28 of the Elections Act NO. 24 of 2011 as amended by Provisions of the Elections Law (Amendment) Act 2017.

Justice John Mativo ruled the petition lacked merits and failed to demonstrate the challenged section of of the constitution were unconstitutional.

“This petition is premised on a clear misapprehension of the law. In view of my findings, I find that the petitioners have failed to demonstrate that the challenged section is unconstitutional or in any manner infringes any provision of the constitution” ruled Mativo.

High Court in February issued temporarily orders restraining Independent Electoral & Boundaries Commission (IEBC) from implementing party hoping laws pending hearing and determination of the petition filed by council of governors.“I hereby stay the implementation of section 28 of the Elections Act NO. 24 of 2011 as amended by Provisions of the Elections Law (Amendment) Act 2017” ordered Judge Mativo.

Council of Governors through lawyer Peter Wanyama moved to court seeking orders to overturn a law that bars politicians from defecting to another party after losing in the primaries.The council sued the Attorney-General and the Independent Electoral and Boundaries claiming that the Election Laws Amendment Act 2017 which kicked off on January 30 contains a problematic unconstitutional section.

The governors further claimed that Section 28 of the Elections Act requires that a political party submits its list of members to IEBC 120 days before polls, meaning a member cannot resign or join another party afterwards.

The county chiefs argued that Section 28 of the amended Elections Act limits the freedom of association and the liberty of making political choices by Kenyans as provided in the Constitution.

In January 2017 Parliament passed the Election Laws Amendment Act of 2017 which purports to give effect to Article 99 (1) (b) of the Constitution, to amend the Elections Act, 2011 and the Independent Electoral and Boundaries Commission Act, 2011; to provide for electoral processes and for connected purposes.

“If implemented as it is, the effect will create a lock up of names and limit genuine and warranted political defection which is a characteristic of any multiparty democracy,” the Council of Governors argued through lawyer Henry Wanyama.

Under the Election Amendment Law, which was enacted last month, a political party is now required to submit its list of party members to the Independent Electoral and Boundaries Commission (IEBC), at least 90 days to the date of the General Election.

The forty-five days window period provided for by the Elections Act, 2011 gave sufficient time before elections for aspirants to political offices to pick and choose Political Parties of their preference to run in the elections with, which is a characteristic of any multi-party democracy.

The changes to the polls legislation require parties to carry out their nominations at least 60 days to the elections rather than the 45 allowed currently.

As a result, the governors say that a member of a political party whose name has been submitted within this duration cannot resign from that party and join another one before the gazette deadline for political party primaries.

“Where a person has genuine, justifiable and warranted reasons for defection after the 120 days deadline, such a person cannot exercise the constitutional political freedom to resign and join another political party and vie for election in the new party (provided the right is exercised within the deadline for nomination set by Independent Electoral & Boundaries Commission)” argues governors.

They argued the restriction of political freedoms is wholly disproportionate to its purported purpose in an open and democratic society.

According to the council, attempts to put political parties’ affairs in order cannot be achieved by unreasonably locking out others in an unfair manner and that the 45 days window period as initially provided by the law was sufficient enough for picking and choosing those to run in the elections.

“By denying members of a political party the right to freely move from one political party to another and still be eligible to contest in the general elections without any unreasonable restrictions limits the right to political participation and association,” Mr Wanyama said.

Mr Wanyama argued that, the Constitution provides for limitation of rights and fundamental freedoms only in reasonable and justifiable circumstances in an open and democratic society based on human dignity, equality and freedom, taking into account all relevant factors.

A Nairobi businessman has today been arraigned in court and charged with obtaining millions.

Abdisamed Mohamed Musa is accused on or before April 16th 2015 at Total petrol station along Lusaka Road in Nairobi County with intent to defraud obtained Sh 9, 000, 000 from a fellow businessman Abdulle Sadiq Ibrahim.

The accused is alleged to have obtained the money by falsely pretending that he was in a position to sell to him a lease for five star limited total petrol station at Lusaka Road knowing it to be false.

The accused is alleged to have committed the offence with another before court. The two matters have been consolidated.

The accused pleaded not guilty before chief magistrate Francis Andayi. He was release on a bond of Sh3,000,000 and one surety of the same amount or a cash bail of Sh 500,000.

Hearing to resumeon May 8th and 10th 2017.

BUSINESSMAN CHARGED FOR KILLING A MAN WHO ALLEGEDLY SEDUCED HIS WIFE.

A businessman has been charged with manslaughter after allegedly killing one Dennis Mnambo Afande on the night of April 8, 2017.

Chief Magistrate Francis Andayi released him on a cash bail of sh 300,000 or a cash bail of 500,000 after he denied the charges.

The court heard that Linus Mutwiri Njagi killed the said man at Pardiso Maseno club along Jogoo road in Nairobi.

According to the police covering report, the accused person stabbed the deceased with a knife whereby he succumbed to the injuries on the way to Kenyatta Hospital.

It is alleged that the reason why accused stabbed the deceased was that the deceased had seduced his wife.

The police state that Njagi  who is also businessman dealing with the sale of tents  at Makongeni along Jogoo road went to Paradiso Maseno club  for refreshments .His wife  joined him later accompanied by another lady and they continued taking drinks together.

Later on five people entered the said bar, the deceased being among them and sat at a table near where the accused and his wife were seated.

The accused and the five persons started to exchange words after they started seducing Faith Kawira Ndeke who is a wife to the accused. At around 11 pm, the accused and the deceased had physical confrontation and he stabbed the deceased severally.

“The suspect had a knife which he insists that he always walk with at night due to the rampant insecurity at Makongeni area. This is seen as thin and slim grounds of possessing a knife mostly at oscial places,” claimed the police report.

According to the police report, even if he was angered by the actions of the deceased and his friends that simple provocation was too naïve to warrant him to commit such grievous crime.

Proceedings to resume on May 29.

OSCAR SUDI KAPSERET MP NEVER ATTENDED OUR SCHOOLS, KIM AND HIGHWAY SECONDARY SAY.

Oscar Sudi, Kapseret Member of Parliament was not our student, Kenya Institute of Management says.

This is according to report from the management school by one Mr John Masheshe.

Mr Masheshe further stated that a registration number appearing on the Sudi’s certificate belongs to another student and the certificate he claims emanated from KIM must have been forged.

His form four certificate according to a letter from the Kenya National Examination Council to EACC is also a forgery since there are no records of a student by the name Oscar Kipchumba Sudi.

“The copy of the certificate was made from a forged document on the basis that, there were no records of any student named Oscar Kipchumba Sudi having sat for KSCE in the year 2016.Further , that there was no school by the name Highway High School and school code appearing on the certificate belonged to Parklands Secondary School” Kashu replied to EACC.

The investigator in his affidavit says upon visiting Highway Secondary school where the MP provided copies of admission records between the years 2003-2006 and the KSCE certificate collections records for the year 2007, The records showed that there was no student by the name Oscar Kipchumba Sudi who enrolled or sat for KSCE examination at the said school.

The documents examiner in his opinion disapproved the leaving certificate provided to IEBC by Mr Sudi alleged to have been signed by the said School principal Jadiel Kaburu Mbogori .

EACC and DPP accused Mr Sudi of attempts to delay the trial in light to contest the Kapseret Member of Parliament using the petition before the Anti-corruption and Economic Crimes Division.

Mr Sudi was arraigned and charged before the Nairobi chief Magistrate court Anti-corruption senior Principal Magistrate Lawrence Mugambi on 6 October last year where he pleaded not guilty and was released on a cash bail.

The politician was required to personally appear today before trial magistrate Felix Kombo after his lawyer’s explanation for his absence was rejected as “dubious.” to show cause why his bail term should not be cancelled to appear in court on Thursday.

However, the Anti-corruption and Economic Crimes Division presiding judge,  Justice Hedwig Ongu’di stayed the trial court proceedings pending hearing and determination of a petition Sudi filed before him.

JUBILEE INCONSIDERATE ACTIONS IN NAIROBI WILL HAND MIKE SONKO A PROTEST VOTE.

Nairobi Senator Mike Mbuvi popularly will win the Jubilee gubernatorial nominations despite being mistreated by the people overseeing the exercise.

Sonko coming from the business world was little known to voters until he thrashed his weight into politics. It is here that he has gained popularity for literally fighting for the less fortunate like the victims of Sinai fire, his philanthropic flare-ups among the poor and the list goes along way.

His rival on the other hand, Peter Kenneth is very popular with managing public resources, making every coin count and is a calm and collected guy, one assumed cannot even kill a fly. The people of Gatanga will attest to this assertion.

PK in 2016-2017 political preparations was championed to unseat Muranga Governor Mwangi wa Iria and was enjoying massive support until he went against the people’s wish to run for the Nairobi gubernatorial seat.

His ambitions in 2013 to be the president were seen as a betrayal on now President Uhuru Kenyatta’s bid.

He has also been christened a spoiler of Nairobi’s game-plan to oust Governor Evans Kidero.

Who then between the two will take the day tomorrow?

Allow me to first state that both Peter Kenneth and Mike Sonko have equal rights to run for the governorship of Nairobi in law and in the city system.

One of them however must be the winner, to fly the jubilee ticket.

MISTREATMENT

The Jubilee party in all sincerity has mistreated Mike Sonko in the glares of camera even trying to block him from contesting on a jubilee ticket until he went to statehouse which then directed he be cleared to run.

Some of the people overseeing nominations within the jubilee secretariat have also shown open contempt for Sonko favoring one whom in their own thinking will win the jubilee ticket.

The contest which was supposed to give jubilee supporters the best candidate has therefore been reduced to a race between the haves and the have nots.

Muranga tycoons have thrown their weight behind Peter Kenneth, a fact well known to Nairobians and are willing to do all what it takes for their son to win the seat.

On the other hand, Mike Sonko is a man of the people, not a single day has Nairobi slept without the mention of his name.

When something debauched happens in Nairobi, Sonko is there helping the victims- the Sonko rescue team, even giving people his posh cars to do weddings.

LOOK HERE NAIROBIANS, THIS IS THE DIFFERENCE.

Sonko touches the hearts of Nairobi residents while PK touches the heart of the owners of Nairobi.

PK is a good manager while Sonko responds in impulse Sonko is down to earth while PK is Humble

PK is diplomatic while addressing concerns while Sonko is an instant justice operative

Sonko get things done in whatever way they may while PK takes the path of less resistance.

REMINDER.

Politics is about the people, the impression you create of solving their problems is what makes or breaks politicians- like are you capable to solve the problems or not and how close a population feels to a politician. This definitely answers the question on who meets this criterion.

WORKING TOGETHER.

Sonko and PK should now forge a front to work together. Some will disagree with my proposition but in politics there are no permanent friends and permanent enemies. It is all about interests. Because both politicians want a better Nairobi, they should merge their vision and actualize it for the benefit of Nairobi residents.  PK needs Sonko as much as Sonko needs PK. Allow me to remind you gentlemen that do not allow criticism get into your heart, it will eat you up like the red ants.
