Former cabinet minister Maina Wanjigi has told court that his family has been subjected to continuous untold abuse, torment and harassment.

He also wants the government stopped

from commencing criminal proceedings against him.

He moved to court to suspend summons to appear before a Nyeri magistrate to take plea on charge of failing to keep safe custody of a firearm.

In a certificate of urgency filed at Milimani law courts this morning , Wanjigi claims that since the raid of his sons property last year, the family has been subjected to continuous untold abuse, torment and harassment by the state, solely on account of Jimmy’s association with the opposition leader Raila Odinga.

The summons come when he is recuperating at his Karen home after undergoing surgery in the United Kingdom.

He said that he was not in a position to swear an affidavit in support of the application filed by his lawyers.

Maina added that he is a disciplined licensed firearm holder with no record of misuse of the firearm for over 50 years.

“On 17th October 2017 while at the home of his son Jimmy Wanjigi he was disarmed of his licensed firearm by officers in a violet, destructive raid on Jimmy’s property, took away his firearm and still hold it to date, ” he says.

The 87 years old former minister further claims that the summons were requiring his attendance at the Nyeri magistrate court and served upon him on March 3 in the evening at his Karen home and he is not in a state to travel to Nyeri.

“He has not been summoned or questioned by the police in respect to any criminal investigations in respect of the claimed charge as required by law,”claims Wanjigi’s lawyer Nelson Havi.

The counsel said that the action or decision to summon Maina to the magistrate in Nyeri is procedural unfair and is therefore erroneous and unlawful.
