Court has directed Victim in the assault case against former Tetu Member of Parliament file a proper application seeking the recusal of chief Magistrate Martha Mutuku.
Milimani Chief Magistrate Mutuku directed the victim to properly file her recusal application.
This means there shall be a delay before the former legislator pleads to the assault charges against the security guard.
This was after it emerged the application was improperly filed as miscellaneous application.
The victim through lawyer Professor George Wajackoyah had earlier made an application oral seeking to have Chief Magistrate Martha Mutuku recused from plea taking of assault case against Gethenji.
When the matter came for mention before the Magistrate Virtually today, the court was informed that the DPP has not responded to an application by Gethenji who is seeking to have his assault charges reviewed.
Githenji is expected to answer to assault charges once application for recusal is heard and determined.
He is also facing other criminal cases before Milimani Chief Magistrate court.
He is said to have assaulted a security guard in Kitisuru on February this year.
